The 2024 lawsuit against WWE, Fanatics, and Cody Rhodes over
the use of the term “American Nightmare” has been settled
out of court.
Wesley Eisold of the band American Nightmare, who filed the
lawsuit, had claimed that Rhodes broke their 2019 settlement
agreement when Rhodes trademarked the term for merchandise
and he was allowed to use it as long as the term is used in
conjunction with his name or likeness and imagery has to be
at least 75% larger than the American Nightmare text.
Rhodes originally paid $30,000 for the agreement and Eisold
was looking for nearly $1 million in damages, trademark
infringement, and legal fees, after he tried to contact WWE,
Rhodes, and Fanatics in 2022 with cease and desist letters.
It was not revealed how much money exchanged hands to make
the lawsuit disappear.
